Terms of Service
The agreement between you and BaobabPOS when you use our point-of-sale service.

These Terms of Service (“Terms”) govern your access to and use of BaobabPOS (the “Service”), operated from South Africa. By starting a trial, creating an account or using the Service, you agree to these Terms. If you’re agreeing on behalf of a business, you confirm you’re authorised to do so.
1. Definitions
- “Account” — your BaobabPOS store, including its subdomain and staff users.
- “Subscription” — a paid plan billed monthly in advance.
- “Your data” — the products, sales, customers and other information you put into the Service.
2. The Service
BaobabPOS provides point-of-sale software delivered over the internet, including sales, inventory, reporting and related features. We work to keep the Service available and secure, and may add, change or remove features over time to improve it.
3. Eligibility & accounts
You must be at least 18 and able to enter into a binding contract. You’re responsible for your account, your staff’s use of it, keeping login credentials (including PINs) secure, and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorised access.
4. Free trial
New accounts include a free 14-day trial with access to the Service’s features. No payment is taken to start a trial. If you don’t subscribe by the end of the trial, your account may be paused and later removed in line with our data-retention practices.
5. Subscriptions & billing
- After the trial, continued use requires a paid Subscription, billed monthly in advance in South African Rand (ZAR) by card via Paystack.
- Subscriptions renew automatically each month until cancelled.
- Prices are shown on our Pricing page and exclude VAT unless stated otherwise.
- You authorise us (through Paystack) to charge your payment method for each renewal.
- If a payment fails, we may retry and may suspend the Account until payment succeeds.
6. Price changes
We may change Subscription prices. We’ll give you reasonable advance notice (at least one billing cycle), and changes take effect at your next renewal. Continuing to use the Service after a change means you accept the new price.
7. Cancellation & refunds
You can cancel anytime from your dashboard or by contacting us. Cancellation stops future billing; your Subscription remains active until the end of the current paid period. Refunds are handled under our Refund Policy.
8. Acceptable use
You agree not to:
- Break the law or use the Service for fraudulent or unlawful activity.
- Attempt to breach security, access other tenants’ data, or disrupt the Service.
- Reverse-engineer, resell or copy the Service except as allowed by law.
- Upload malware or use the Service to infringe others’ rights.
9. Your data
Your data remains yours. You grant us a limited licence to host and process it solely to provide the Service. You’re responsible for the accuracy and lawfulness of the data you enter, and for complying with applicable laws (including tax, consumer-protection and privacy laws) in running your business. You can export your data, and we’ll provide reasonable assistance to retrieve it if you leave. We handle personal information as described in our Privacy Policy.
10. Our intellectual property
The Service, including its software, design, and the BaobabPOS name and logo, belongs to us and our licensors. These Terms don’t transfer any of our intellectual property to you beyond the right to use the Service.
11. Third-party services & hardware
The Service works with third-party tools and hardware (for example, Paystack for payments, and Speedpoint card machines, receipt printers and cash drawers). We’re not responsible for third-party products or services, which are governed by their own terms.
12. Availability & support
We aim for high availability but don’t guarantee the Service will be uninterrupted or error-free. We may carry out maintenance, occasionally with downtime. Support is provided per your plan; Enterprise plans may include a separate service-level agreement.
13. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all implied warranties, including fitness for a particular purpose. This does not limit any rights you have under the Consumer Protection Act that cannot be excluded.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses (including lost profits or data). Our total liability for any claim relating to the Service is limited to the Subscription fees you paid us in the three months before the event giving rise to the claim.
15. Suspension & termination
We may suspend or terminate your Account if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to us. You may stop using the Service at any time by cancelling. On termination, your right to use the Service ends, and we may delete your data after a reasonable retention period.
16. Changes to these Terms
We may update these Terms from time to time. We’ll post the updated version here with a new “Last updated” date and, for material changes, give reasonable notice. Continuing to use the Service means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute, without affecting your statutory consumer rights.
